1. Who These Terms Apply To

These Terms of Service ("Terms") govern your use of firemarketingpros.com (the "Site") and any marketing services provided by Boki Gelato LLC, DBA Fire Marketing Pros ("we," "us," or "Fire Marketing Pros"), located in Sioux Falls, SD.

By accessing the Site or engaging our services, you agree to these Terms. If you do not agree, do not use the Site or our services.

2. Website Use

You may use this Site for lawful purposes only. You agree not to:

• Use the Site in any way that violates applicable laws or regulations
• Attempt to gain unauthorized access to any part of the Site or its infrastructure
• Scrape, copy, or reproduce Site content without written permission
• Use the Site to transmit spam or unsolicited communications
• Impersonate Fire Marketing Pros, Borjan Jaksic, or any other person or entity

We reserve the right to terminate access to the Site for any user who violates these Terms.

3. Agency Services

3.1 Scope of Services

Fire Marketing Pros provides digital marketing services exclusively for fire protection companies, including but not limited to: website design and development, local SEO, Google Ads management, GoHighLevel (GHL) CRM setup and automation, Google Business Profile optimization, and review generation.

The specific services, deliverables, and fees for each client engagement are defined in a separate Service Agreement or Statement of Work signed by both parties. These Terms apply in addition to any such agreement.

3.2 Month-to-Month Agreement

All Fire Marketing Pros service agreements are month-to-month with no long-term lock-in. Either party may terminate the engagement with 30 days' written notice. No cancellation fees apply.

3.3 Client Responsibilities

To deliver results, clients agree to:

• Provide timely access to required accounts (Google, GHL, domain registrar, etc.)
• Respond to requests for content, approvals, or feedback within 5 business days
• Provide accurate information about their business, services, and service areas
• Maintain accounts in good standing (e.g., Google Ads billing active)

Delays caused by a client's failure to fulfill these responsibilities do not constitute a breach by Fire Marketing Pros and do not entitle the client to a refund or service credit.

4. Payments

4.1 Fees

Service fees are as agreed in the client's Service Agreement. Current package pricing is listed on the Services & Pricing page. Fees are invoiced monthly, in advance, at the start of each billing cycle.

4.2 Late Payments

Invoices are due within 7 days of issue. Accounts more than 14 days past due may result in a pause of active services until the balance is resolved. Fire Marketing Pros reserves the right to charge a 1.5% monthly late fee on overdue balances.

4.3 Refunds

Because digital marketing services involve immediate labor and third-party costs (ad spend, software, etc.), fees paid for the current billing cycle are non-refundable upon cancellation. Work completed up to the cancellation date is billable at the agreed monthly rate.

5. Intellectual Property

5.1 Work Product

Upon receipt of full payment, clients own the deliverables created specifically for them (website files, ad copy, content). Fire Marketing Pros retains ownership of proprietary frameworks, templates, processes, and methodologies used in delivering those services.

5.2 Site Content

All content on firemarketingpros.com — including text, graphics, logos, and the "Fire Protection Growth System" methodology — is owned by Boki Gelato LLC DBA Fire Marketing Pros. You may not reproduce, distribute, or create derivative works from this content without written permission.

5.3 Portfolio and Case Study Rights

Fire Marketing Pros reserves the right to reference client work as case studies or portfolio examples, including general results and metrics (without disclosing confidential business information), unless the client requests otherwise in writing.

6. Results and Guarantees

Digital marketing results depend on many factors outside our control, including Google algorithm changes, market conditions, competition, and client responsiveness. Fire Marketing Pros does not guarantee specific rankings, lead volumes, or revenue outcomes.

We offer a Right Fit Guarantee: if after the first 30 days you feel the engagement is not a good fit, we will work with you to find a resolution. This does not override the payment terms in Section 4.

7. Limitation of Liability

To the maximum extent permitted by law, Fire Marketing Pros shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or our services, including but not limited to lost revenue, lost data, or business interruption — even if we have been advised of the possibility of such damages.

Our total liability to any client for any claim arising out of a service engagement shall not exceed the total fees paid by that client in the 30 days preceding the claim.

8. Third-Party Services

We may recommend or use third-party platforms (Google Ads, GoHighLevel, Cloudflare, etc.) to deliver services. We are not responsible for the terms, performance, pricing changes, or outages of these third-party platforms. Any costs associated with third-party platforms (ad spend, software subscriptions) are separate from our agency fees unless explicitly bundled in a Service Agreement.

9. Confidentiality

Both parties agree to keep confidential any proprietary business information shared during the engagement — including client business data, strategy documents, and financial details — and not to disclose such information to third parties without written consent.

10. Governing Law

These Terms are governed by the laws of the State of South Dakota. Any disputes arising under these Terms shall be resolved in the courts of Minnehaha County, SD, or through binding arbitration as mutually agreed.

11. Changes to These Terms

We may update these Terms at any time. The "Last updated" date at the top reflects the most recent revision. Continued use of the Site or services after an update constitutes acceptance of the revised Terms. We will notify active clients of material changes via email.
